1. Parties and acceptance
These terms govern use of the SmartChannel AI service (the "Service") provided by D20 Reklamcılık ve Prodüksiyon Hizmetleri Limited Şirketi ("D20"). By using the Service you accept these terms and the Privacy Policy (https://smartchannel.d20.com.tr/privacy).
2. The Service
SmartChannel is an analytics service that helps brands and agencies search, compare and select YouTube channels for campaigns. The Service is under development; features may change with notice.
3. YouTube Terms of Service
SmartChannel uses YouTube API Services. By using SmartChannel you agree to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms. Data from YouTube is also subject to the Google Privacy Policy: http://www.google.com/policies/privacy. These links and YouTube's notices are not removed or obscured in the Service.
4. YouTube data and SmartChannel analyses
- Channel and video information shown in the Service comes from YouTube and is displayed with the "developed with YouTube" logo, which links to YouTube, and YouTube as its stated source. YouTube does not endorse or sponsor SmartChannel.
- Indicators and assessments produced by SmartChannel are calculated by SmartChannel and are not YouTube data; they are labelled as such and shown separately from YouTube figures.
- Analyses support decisions; they do not guarantee a channel's campaign results.
5. Data freshness
Data is refreshed regularly but may differ from the live value on YouTube. Historical data is shown with its date.
6. Prohibited use
Users may not:
- bulk download, copy, sell or use as a data source for another service any YouTube data or analyses from the Service;
- use the Service to produce market statistics about YouTube as a whole;
- use the Service to harass, target or discriminate against any channel or person;
- access the Service with automated tools or attempt to circumvent its security.
7. Account
Users are responsible for keeping their credentials confidential. D20 may suspend or close accounts used in breach of these terms. Users may close their account at any time; deletion follows Section 8 of the Privacy Policy.
8. Intellectual property
SmartChannel software, methodology and analyses belong to D20. YouTube data and YouTube brand features belong to YouTube and Google.
9. Limitation of liability
The Service is provided "as is". To the extent permitted by law, D20 is not liable for indirect damages arising from interruptions or changes in YouTube API Services or from decisions made on the basis of analyses.
10. Changes
D20 may change these terms; the new text is published on this page and significant changes are notified to dashboard users.
11. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul Anatolian Side have jurisdiction over any dispute.
